GDPR and Special Category Data

The new General Data Protection Regulation (GDPR) comes into force on 25th May 2018.  It is expected to significantly change data protection obligations for employers, and how they handle sensitive information, for example about employees’ physical or mental health.

The Information Commissioner’s Office (ICO) states that information about an employee’s health will be ‘special category data’.  This is where certain personal data is more sensitive, and therefore needs additional protection as well as the usual lawful basis for processing data.
